Whitmer also filed a lawsuit asking the state Supreme Court to declare the 91-year-old law unconstitutional. He has not yet acted. Abortion rights supporters in Michigan hope the issue will be put to a vote this fall. The proposed constitutional amendment would affirm the right to make pregnancy-related decisions without interference, including abortion and other reproductive services such as birth control. The Committee for Reproductive Freedom for All must collect about 425,000 signatures from valid voters by July 11 to hold the November vote. The measure would become law if voters approved it. The issue is also expected to dominate national elections – Whitmer and Nessel are both running for re-election in the autumn – and the general legislative races. Regional bodies such as the Inter-American Court of Human Rights, the European Court of Human Rights and the African Commission on Human and Peoples` Rights (ACHPR) have also been very active in this regard. The ACHPR called for the decriminalization of abortion in Africa in January 2016 in accordance with the Maputo Protocol and renewed this request in January 2017, making waves across the region.8 Next steps: Providers are preparing for an increase in the number of women coming from other states for abortions. Most non-evangelical white Protestants (75%), black Protestants (71%) and Catholics (66%) say abortion should be allowed in this case, while white evangelicals are more divided: 40% say it should be legal, while 34% say it should be illegal and about a quarter say it depends on it. Among Protestants, white evangelicals are distinguished by their opposition to abortion. By the sixth week of pregnancy, for example, 44 percent say abortion should be illegal, compared to 17 percent of non-evangelical white Protestants and 15 percent of black Protestants. This trend is also evident in weeks 14 and 24 of pregnancy, when half or more of white evangelicals say abortion should be illegal. Political control: The Iowa legislature is controlled by Republicans who want to ban or restrict access to abortion and a Republican governor who agrees and is running for re-election this year. Under the legal system created by the United States Constitution, the power to legislate rests with Congress and state legislators. It is not for the Supreme Court to substitute the political preferences of its members for those expressed in laws promulgated by the elected representatives of the people.

The role of the judiciary in constitutional review is to determine whether the impugned law violates a constitutionally protected right. In 2020, Tennessee passed a law banning most abortions if the fetal heartbeat can be detected after about six weeks, before many women know they`re pregnant. The measure was never enforced because it was quickly blocked by a federal court. Tennessee voters approved an amendment in 2014 that declared that the state constitution neither protected nor guaranteed the right to abortion or required funding for abortion, and authorized state legislators to “enact, amend, or repeal abortion laws.” State law also does not allow providers to dispense abortion medication through telemedical consultations. There are six abortion providers in Tennessee. In Turkey, for example, in response to population growth, the government passed a law in 1983 allowing regulation of fertility, abortion on demand up to 10 weeks after conception, and sterilization. A married woman seeking an abortion only had to obtain her husband`s permission or make a formal declaration of responsibility before the procedure.26 In recent years, however, President Erdogan has taken a pro-natalist stance, urging Turkish couples to have at least three children.
